Towards a legal framework for military cyber operations
Samenvatting
The authors concentrate on the legal framework for cyber operations. Analysing this framework, covering the legal bases in order to initiate cyber operations, as well as the applicable regimes that govern the conduct of operations, shows that various sorts of cyber operations do not fit nearly into existing laws and treaty. In the domestic sphere, legislation is defensive and reactive in nature, and often drafted with an eye to kinetic force. Internationally, cyber operations require interpretation of both the ' ius ad bellum' as the 'ius in bello'. For the military, ICT governance is still a black hole, to be covered swiftly.
